The Bail Process Explained

A lot of Americans have not been involved in the bail process. It is probably quite fortunate for these people that they haven't. It can be a very daunting, frightening, and stressful process. Knowing what to do, who to call, and who to turn to for help are questions that will be flooding their minds. Thankfully, there is one bail bonds Arcadia company, available to assist.

Once an individual has been arrested, they will be taken to a nearby law enforcement station for booking and processing. Their name will be entered into the system, fingerprinted, photographed, and they will also learn whether they will be eligible for bail or not. If they are eligible for bail, they will then be allowed to make one phone call to seek assistance.

Bail amounts in the state of California are the highest anywhere in the United States. Due to this, very few people have the cash, or collateral to pay for the bail on their own. For this reason, most people will seek out the assistance from a professional bail bonds company such as ARC Bail Bonds.

If someone is fortunate enough to be able to afford bail without assistance, this is paid to the court and the defendant will be free to go home until they are required to appear in court. If however, they do not follow the bail conditions and miss their court date, bail will be revoked, a bench warrant issued, and Government resources will be used to apprehend the defendant. The defendant will then be taken back into custody, they will forfeit their bail, and never again be eligible to receive bail.

If the defendant follows all their conditions, including attending each required court date, bail will be returned once their case is finalized. Of course, any costs and associated fees can also be taken from the bail prior to it being returned.

The other option is to use a professional bail bonds company. For a fee, a bail bonds company will post bail on behalf of the defendant. The defendant is then obligated to the bail bonds company, and any conditions they attach to the bail bond. This could include checking in weekly, advising of a change of address, and if a payment plan has been organized for the fee, then the payment schedule must be kept to. If the defendant skips out on bail, then the bail bonds company will attempt to track them down, apprehend them, and return them to custody. As with paying bail themselves, if a defendant does not meet the conditions, bail will be revoked, and they will not be eligible to receive bail again.
